Terms of Service

These Terms of Service ("Terms") govern your use of the Strait Up Maritime platform and website at straitupmaritime.com (the "Service"). By creating an account or using the Service, you agree to these Terms.

The Service is owned and operated by Prime Calibre Limited, a company registered in Hong Kong ("Product Owner"). Subscriptions purchased through straitupmaritime.com are sold by Prime Calibre Pty Ltd (ABN 76 678 167 407), a company registered in Australia ("Reseller"), an authorised reseller of Prime Calibre Limited. References to "we", "us", and "our" in these Terms refer to the Reseller unless otherwise stated.

1. The Service

Strait Up Maritime provides a maritime sanctions screening and compliance monitoring platform. The Service includes vessel screening against international sanctions lists, watchlist monitoring, alert notifications, fleet mapping, and compliance reporting tools delivered via a web dashboard. The platform, its intellectual property, and underlying technology are owned by Prime Calibre Limited (Hong Kong).

2. Accounts

You must provide accurate information when creating an account. You are responsible for all activity under your account. One account per person — do not share login credentials. We may suspend or terminate accounts that violate these Terms.

3. Acceptable use

You agree not to:

  • Use automated tools, scrapers, or bots to extract data in bulk from the Service
  • Resell, redistribute, or sublicense data obtained from the Service
  • Circumvent plan limits, rate limits, or access controls
  • Use the Service to facilitate sanctions evasion or other illegal activity
  • Attempt to access other customers' data or accounts
  • Reverse-engineer, decompile, or probe the Service's infrastructure

We may suspend your account immediately if we detect abuse, and will notify you by email.

4. Plans and payment

Free accounts are available with limited features. Paid plans are billed monthly via Stripe. You may cancel at any time — access continues until the end of the billing period. We do not offer refunds for partial months. We may change pricing with 30 days' notice.

5. Scope of Service and data sources

Strait Up Maritime is an informational screening and monitoring tool. It aggregates data from public sanctions lists maintained by OFAC, the EU, the UN, UK OFSI, Australia, Japan, and Switzerland, together with AIS position data, vessel registries, and other third-party sources. We do not originate this data. While we take reasonable steps to keep our data current, sanctions designations and maritime data change frequently and without notice. Third-party sources may contain errors, omissions, or delays between the time a designation is made by an authority and the time it appears in our system.

5a. No reliance for legal or compliance determinations

Screening results are informational only. They do not constitute legal advice, compliance advice, a legal opinion, or a regulatory determination. The Service is not a substitute for qualified legal counsel or your organisation's own compliance program. We are not a regulated financial services provider, a law firm, a legal services provider, or a sanctions authority. We are not authorised by OFAC, OFSI, or any other regulatory body to make compliance determinations on behalf of any person or entity.

5b. No warranty

We make no warranty that screening results are accurate, complete, current, or sufficient for any particular compliance, regulatory, legal, or commercial purpose. We make no warranty that the Service will detect or correctly classify any particular vessel, entity, or transaction. A result of "no matches found" means that the vessel does not currently appear on the sanctions lists screened at the time of query — it does not constitute a guarantee that the vessel is not owned by, operated by, or connected to sanctioned entities, nor that new designations will not be made in the future.

5c. Customer obligations

You are responsible for:

  • Maintaining your own compliance program appropriate to your regulatory obligations
  • Making independent compliance determinations based on your own assessment of the facts
  • Consulting qualified legal counsel for sanctions compliance matters
  • Not relying solely on the Service for any regulatory, legal, or material commercial decision
  • Verifying critical screening results against primary sources (e.g., OFAC SDN list, EU Consolidated List) before material transactions

The Service is not a substitute for professional legal or compliance advice.

6. Intellectual property

The Service, including its design, features, data analytics, and proprietary technology, is owned by Prime Calibre Limited (Hong Kong). The Strait Up Maritime name, all related trademarks, and the underlying platform IP are the property of Prime Calibre Limited. Prime Calibre Pty Ltd is authorised by Prime Calibre Limited to use the Strait Up Maritime name, trademarks, and branding solely in connection with the resale and delivery of the Service under these Terms. All rights in the Strait Up Maritime name and related trademarks remain with Prime Calibre Limited.

You retain ownership of any documents you upload. By uploading content, you grant us a limited licence to store and serve it back to you as part of the Service.

7. Privacy and data processing

Our collection and processing of personal data is governed by our Privacy Policy and, for customers in the UK, EU, or EEA, our Data Processing Agreement, each of which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the Privacy Policy and, where applicable, the DPA.

8. Press access

Press accounts are provided at our discretion to verified journalists. Press access is equivalent to our Lookout plan and is subject to these Terms. We may revoke press access at any time. Data used in publications must be attributed to "Strait Up Maritime" and should include the qualifier "based on public sanctions data aggregated by Strait Up Maritime" where the data is used to characterise the sanctions status of a specific vessel.

8a. News aggregation and AI-generated content

Strait Up Maritime publishes a news section at api.straitupmaritime.com/news containing AI-generated summaries of public sanctions announcements. The following terms apply to that section:

  • Source restriction. News content is sourced exclusively from public-domain government publications: the U.S. Department of the Treasury Office of Foreign Assets Control (OFAC), and the UK Office of Financial Sanctions Implementation (OFSI), the latter under the Open Government Licence v3.0. We do not aggregate, scrape, or republish content from commercial maritime publications.
  • AI-generated. News summaries are produced automatically by a large language model. They may contain inaccuracies, omissions, mistranslations, hallucinations, or out-of-date information. We do not warrant the accuracy, completeness, or timeliness of any news summary.
  • Not advice. News summaries are journalism for general information and search-engine indexing. They are not legal advice, compliance advice, sanctions advice, financial advice, or a regulatory determination. They do not establish a professional relationship between you and us. Do not rely on a news summary as the basis for any compliance, regulatory, commercial, or legal decision. Always verify against the official issuing authority before acting.
  • No name-based linking. News summaries do not automatically associate named entities with specific records in our sanctions database based on name alone. Where the same name appears in both, no inference of identity should be drawn.
  • IMO citation links. Where an IMO number explicitly appears in the source publication and matches a record in our sanctioned-vessels database, we may render it as a hyperlink to that record. IMO numbers are globally unique 7-digit identifiers issued by the IMO and are not reused, so a hyperlink on an IMO citation is a navigational convenience, not an editorial assertion of identity. Even so, you should verify against the official source before relying on any record.
  • Corrections and takedown. If you believe a news summary contains an error, misattributes information, or that you are the rights-holder of source material that should not be republished, contact [email protected]. We will review correction requests within 5 business days and takedown requests promptly.
  • Limitation extends. The disclaimers, limitations of liability, and indemnification clauses in sections 9 and 10 of these Terms apply with full force to the news section and any reliance you place on its content.

9. Limitation of liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or accuracy. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to:

  • Losses resulting from reliance on screening results, including regulatory fines, penalties, or enforcement actions
  • Losses arising from a false negative (a sanctioned vessel not being flagged) or a false positive (a non-sanctioned vessel being flagged)
  • Losses arising from delays between a sanctions designation and its appearance in the Service
  • Losses arising from errors, omissions, or inaccuracies in third-party data sources
  • Losses arising from reliance on news summaries published in the /news section, including any inaccuracies, omissions, or AI-generated errors
  • Lost profits, lost business, or reputational damage

Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim. This limitation does not apply to liability arising from our wilful misconduct or breach of confidentiality obligations.

10. Indemnification

You agree to indemnify and hold harmless Prime Calibre Pty Ltd, Prime Calibre Limited, and their respective officers, directors, and employees from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your reliance on screening results for compliance, commercial, or regulatory decisions; (c) any third-party claim arising from your transactions or decisions made using information obtained from the Service; or (d) your breach of these Terms.

11. Availability

We aim for high availability of the Service but do not commit to specific uptime percentages at this time. We may perform maintenance with reasonable notice. Where the Service is materially unavailable for more than 24 hours in a calendar month for reasons within our control, paid customers may, at their written request to [email protected], receive a reasonable pro-rata credit on their next monthly invoice. AIS data coverage, sanctions list updates, and other third-party data feeds depend on external providers and are outside our control. Service credits are the sole and exclusive remedy for any unavailability.

12. Termination

You may delete your account at any time via the dashboard settings page, or by emailing [email protected]. We may terminate your account for violation of these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Changes

We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. Disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
